MOT Fail ?

Quick question, I can't seem to find an answer Y/N on the various MOT websites.
Xantia.
You know the rubber gaiter that's on the back hydraulic units in the arm assembly.. if it's split, would this be classed as a failure - I can't see a yes or a no anywhere.

Its not a fail point as far as I know: they are only looking for leaks and ineffective operation.
Many "normal" i.e. non-hydraulic rear dampers have a totally naked rod with no gaiter at all.

The shocks on my Dad's Cherokee had nice blue gaters on them. One day there was little bits of blue plastic / rubber on the floor underneath it, rabbits (I assume it was the rabbits since we have loads of the little blighters) had chewed part of the gaters off on one side.
Anyway, it passed the MOT with chewed shocks and they are still healthy to this day (although one side is slightly naked at the bottom).

I believe its okay as long as the tester does not see anything dripping out.
