A MOT tester, not my usual guy, once told me that as soon as he issues a fail that overides the valid MOT and renders the vehicle illegal to use. However this is a garage that has a reputation for being real rip off merchants and I suspect he was trying to get the job of fixing the faults at a vastly inflated price.

Doesn't your insurance require you to keep the car in a roadworthy condition - or somesuch clause ? Wouldn't an MOT failure (before the old MOT ran out) give the insurance company a 'get out' if your car was then involved in an accident and the subject of the MOT failure had a direct bearing on the crash ? Take, for example, the car failed on badly aligned or not working headlights, and you crashed at night. Your car would technically have a valid MOT as the previous one hadn't run out, but the insurers could then say you were knowingly using the car in an un-roadworthy condition.
I suppose, in the end,....... "That's for the lawyers to decide" (The Simpsons ?) :-D

Well I'm still confused.
As I get older I think a lot about the hereafter - I go into a room and then wonder what I'm here after.

I haven't been following this chaps.. but i thinl my mot centre has a poster on the wall saying that if you fail go home or go to repair ..regardless of current mot expiry .. will take a pic of it tomorrow

Ok chaps, just pulled this off the AA website which may clarify some of this:
Getting an MOT early
You can take your car for an MOT up to a month early and preserve the same renewal date but what happens if the car fails the test?
Your vehicle still has a current MOT as the expiry date of the old MOT still stands so if you take your car away you will not be committing the specific offence of driving a vehicle without a valid MOT.
However it is an offence to drive a vehicle with a known defect and to drive an unroadworthy vehicle so you can't simply ignore the test result and continue to drive the car normally until the old MOT expires.
You can be fined up to £2500, be banned from driving and get three penalty points for driving a vehicle in a dangerous condition.

So although you are legally entitled to drive your car without an MOT to the test station (if pre-booked - and I guess if stopped you would have to be able to evidence this) or away from an MOT test station if it has failed the MOT - it must still be in a roadworthy condition regardless. I.e. if the MOT failed on the driveshaft being knackered and you drove it away to a garage to get it fixed, with the wheel at a 45 degree angle, you are committing an offence as you know it is dangerous and unroadworthy! You would have to arrange to have it towed off road in that case.

Merely confirms what I already knew. It doesn't say what would happen if you tried to tax it after getting a fail.

Tax only requires a valid mot and insurance, I'll bet that it can be taxed regardless in this situation.
If not then I once managed to sneak a big red van through the dvlas guard!

Edit: Had a response, Question & Answer:
"Lets assume you have a valid MOT certificate that expires in 1 month. You decide to take your car for an early MOT. The car then fails the MOT. The question is are you able to tax your vehicle using the original valid MOT or, will the fact that the recent MOT has now been recorded as a failure on the database overwrite this and prevent you from taxing the vehicle when they look up the electronic records when taxing".

Answer: "The original MOT certificate is valid for 12 months you are still able to tax your vehicle."

Maybe valid but YOU have knowledge the car has faults, that effects your insurance.
