Fair enough, you were. However, get her in on 28th May, so you have a longer MoT (or, if needed (unlikely) time to fix things).

Is it not the case that if it fails then it's recorded? What would the legal position be for driving it around and, heaven forfend, if it were involved in an accident?

Well the retest procedures state:
"There is no set time limit before a retest and it is at the discretion of the individual. Remember - a car that does not have a current MOT Certificate is not allowed to be used on the road except when going for repairs for an MOT test, or to a prearranged MOTtest".

That's why it's always better to get it done earlier than the due date (up to a month earlier IIRC to preserve the MOT anniversary), so I presume you would still be covered under your old MOT certificate for use on the road in the interim - unless of course it has failed and in that case voids your old certificate  :?:

A failure doesn't void the current cert if it's in date. There are issues of legality concerning the matter of roadworthiness though..

So ... you mean insurance issues in the event of anything untoward happening?

Say your car's tax falls due on the first of May and the MOT expires on May 3rd. You put it in for an MOT on April 25th and it then fails. Am I correct in thinking that you can't then tax your car after the fail?

Unless the rules have changed very recently, yes, you're incorrect. I taxed a car in September that had 3 days MOT remaining.

So what exactly are the 'issues of legality'? Is your current mot valid or not then ... assuming a recent fail.

Valid till it runs out. You should not drive it however as it has "known" faults thus it invalidates your insurance. (maybe not the 3rd party aspect)

Umm, not sure whether you're agreeing with me or disagreeing.

I'm perfectly aware that you can tax a car with even only one day's MOT left valid if it happens to be the first day of the month that the tax is due - I've many times in the past used done that. What I'm asking is: if the car fails an MOT in that short period does that stop you retaxing a car even if, as has been said above, the car still legally has valid MOT?

It doesn't invalidate your insurance at all.

It's perfectly legal to use. The same rules that are present when it's MOTed are still in force.

You *could* be prosecuted for driving a dangerous or unroadworthy vehicle, but a valid MOT is no guarantee of a vehicle not being dangerous or unroadworthy. Just because a vehicle failed an MOT doesn't mean it's dangerous.

Using Google will show I'm correct.

It does, because you KNOW the car has faults if it has failed. You will then be driving it against the clauses......
