That said, in this case the UK Gov guidance seems correct if vague. Its your interpretation of the UK Gov that's wrong. The UK Gov guidance you have quoted refers specifically taking a vehicle away from an MOT test to fix defects which have caused an MOT fail, which is consistent with the law. Not for driving a vehicle to a garage for repairs which have not caused an MOT fail, as is the case for the OP.

Well I suspect I'm 99.99% sure that not everyone walks around with a copy of the 1981 Motor Vehicles Test regulations in their back pocket. Although ignorance isn't a defence, I would still bet money that quoting the guidance from the GOV.UK website would still be sufficient as a defense - assuming the car was not dangerous of course - as again in another section:

I can't see any one being able to challenge that from an official source as it currently stands.

If the MOT has run out
If your tax is due to run out, register your vehicle as ‘off the road’ - you cannot renew your vehicle tax if your MOT has expired.

Book an MOT test.

Tax your vehicle once it has passed its MOT.

You cannot drive or park your vehicle on the road if the MOT has run out. You can be prosecuted if caught.

The only exceptions are to drive it:

to or from somewhere to be repaired
to a pre-arranged MOT test
And there I'll leave it - as with anything people need to make their own judgements on any advice offered.

The advice from the DVLA on all these matters is: "The courts alone have the power to interpret the law."
