If only I know what was going to happen on that roundabout I'd had overtook him on the inside on the straight before the roundabout. :rofl2: :^o

I just don't believe that the OP is at fault for one minute, would be interesting to get an overall view.

Just because he isn't at fault doesn't mean he couldn't have avoided it.

You are still in hospital no matter who's fault it is. :(

If my anticipation was better, I could have left the cars at home both times.

I can remember at least two occasions where I have avoided being rear ended by leaving enough room to get out of the way quickly and paying attention to what was coming from behind. I could have just sat there and said it's not my fault but at least 3 vehicles would have been involved meaning a messy insurance claim.

I never once said it couldn't be avoided, I was just saying it wasnt my fault so a 50/50 claim would never have been accepted even if my insurance company said so, i'd have went to court. The law states that they must prove beyond all reasonable doubt that I was at fault.

As I understand the matter you are not seeking to demonstrate the other driver has committed a criminal offence, simply seeking to establish 'fault' for the purpose of apportioning civil liability for the damage caused. That being the case, the relevant standard of proof is the balance of probabilities, not beyond reasonable doubt.

Well that and also if the police did get involved, who would be the one taken to task (not mentioned in my post).

I would say the CRV is at fault for changing lanes where he / she did and for not doing his / her Mirror Signal Manoeuvre bit. But personally, I've seen enough of the same behaviour to do a Marty Feldman and ALWAYS keep an eye on my right for these idiots. Also, watching the video again, I'm sure the CRV pulled into the left before exiting - so doubly dumb.
MF.PNG
So the CRV is wrong - but the issue is more do you want to avoid a potential incident? - or drive regardless, trusting that everyone else is faultless too, and go through the hassle of a crash and all that goes with it?

PS - As for a previous suggestion - we can't set up a poll mid point in a thread.

I had an in-car video camera before they were called dashcams, some of the footage was entertaining (especially the Indian stuff) but editing, downloading, etc was tedious, so the novelty wore off - don't even know where it is now; no great loss!

My Mum has just told me that the dash cam I bought her recently for her narrow boat has already earned its' keep.

A few months back Mum told me of an incident where a group of men hired a narrow boat for a stag party, got drunk, and bounced their vessel off others that were moored up (Mums' boat, The Black Cat, was one that got hit, but not damaged). When I heard this I got her a dash cam, which she mounted into the bow windows. Anyway, onto the latest incident.

Another group of drunks were on a narrow boat, ricocheting off moored boats, and they hit a vessel that was not in great shape. They pulled a tarpaulin off (well, the current they generated did), and said vessel rocked over far enough for her to sink. Well, the dash cam caught enough details for the police to accept they had enough evidence. Mum cannot help pump out the boat, but she is providing plenty of hot drinks to those who are (and in the current weather conditions that is highly appreciated).

You get idiots in all walks of life. It only really becomes a nuisance when their actions adversely affect others.

This is just one report on the incident in question. George Ward (whose boat was damaged) has, by more than one reporter, been incorrectly named as George KANDA. This is an error. This incident happened on the Kennet and Avon Canal, which is often know as the 'K' and 'A' (so has been interpreted wrongly as KandA).

I have not yet tracked down the footage from Mum's dash cam, although the BBC appear to have it.
