That could be the case, but it depends on the wording of the letter that came with the cheque, if it has words like "full and final offer", then banking the cheque is deemed to be legal acceptance.

Yes, but as a consumer, you probably still have wriggle room if the Ombudsman is invoked. It would be reasonable (specifically chosen word for legal purposes) to suggest that a car driver is not automatically qualified as a lawyer, and that they might not understand the specific import of a term like "without prejudice" or "final offer".

Either way, insurance companies are ****ed. Like banks, I despise them through and through.
