If the car only has to be visibly fitted with a cat converter if it came with one, but doesn't need one to pass the relevant emissions test for its year of construction then why not grab a knackered one rip out the innards?
You could probably tell it doesn't work from the test results, but the tester couldn't fail it because:
1: it's there
2: the emissions are acceptable
3: without actually removing the cat and having a look, they won't be able to tell whether it's been modified.

if its a petrol car they might be able to tell by the emissions test that there are no innards to it, even more likely if the car is late enough to be fitted with a fore and aft lambda sensor,
this might even affect the emission result on a diesel
