As you intend to continue using your car it can help to have documentary evidence of road worthness. Do not MOT the car but get your usual MOT examiner to check just the damaged/repaired area and give you a note confirming roadworthness. If it costs then this is one of your uninsured losses to be split 50/50. Once you have this your insurance company cannot declare your car scrap or cancel the remaining term of your insurance.

thanks John i was wondering about this...

it seems its only my word to say the car is safe (it is fine as most damage is plastic)

I am on good terms with my MOT'r so getting a note is no problem, to be honest though, you can only see damage with the front of the car off (will post a pic soon) to show what I mean..

I had another call from the other parties insurance, asking me again whether I want to claim for my damages, they are happy to pay half.. it's like they want me to claim and cost them money ? or by me not claiming anything, I am messing the system up for them ? ...

Hi John

The reason that the other insurance company want you to confirm that you are claiming half from them is that there are two separate ways of interpreting 50/50. Total both bills and pay half each. The simpler alternative is that both insurance companies meet their own costs. Stop saying that your car is not economic to repair and let them know you are getting a couple of written estimates for full repair including one from a dealer. From your description these are likely to come out in the £800/£1200 range. If they see that things are likely to be much closer then the simplicity of the own costs option might then be acceptable to both parties.

hi John, thanks again..

but I still dont quite get it..

if my repairs are 8-1200 the car is gone.. i get back whatever they value it at, less a hefty excess, my policy is then stopped on all three vehicles that are insured under it..

I end up with no car, no insurance, and £200 ..

its got leather and a full tank of fuel, alloys.. and unless I buy it back off them and then re MOT it at more cost, I loose all of that too..

what am I missing :) ?

Basically the car needs a second hand bumper, a headlight, an inner bumper (all already brought and delivered to me, thanks to Paul on here)

so I should be back in it on Monday.. with a dent to a wing and bonnet which I can live with...

I think it's sunk in..

if her damage is 2K and mine is £1800 for example, then her company will (probably) pay her costs and mine would pay my costs, but I wont claim for them - therefore I wont loose any no claims, and thats that ?

when i injured my CX saffari about three years ago my insurance company said they were going to cancel my policy, untill i had sent them proof of a new MOT, VIC TEST and an enginers report to show the car had been sortted corectly,

bearing in mind i have road risk cover to allow me to drive any car in my care, my own and customers cars,

so i rearly need my insurance to let me go about my work,

so i got on to them and after about three phone calls they agreed to allow me to keep the insurance runnig as long as i did not use the CX on the policy untill i had given them the proof they had asked for

I agree with the above that you should get one quote at least from citroen and then find the most expensive independant that would do the work and get a quote from them. this will then equal things out and your insurance co wont pay anything...

how are you 50% to blame though?? i've had some crash's myself in the past but not 1 was my fault luckily(touching lots and lots of wood things for the rest of the day....)

PS are you sure thats not push the drivers side leg of the car in a bit as they are meant to really crumple in an impact??

Ps if you need any lights or an ECU for you xantia at any point let me know as got a few spares for a series 2 :)

hi Kp :D

the main structural part looks fine, but some of the thin sheet metal is a bit warped as you can see. I think it does little more then hold the bumper on.. although there is a rubber item with wires hiding in the crumpled bit, I can only guess this is an airbag activation item ?

As to the blame, on an open forum I will say that 50/50 is a ahem, good outcome..

may drive the car off to a garage over weekend to get an estimate...

this must be the alarm siren... I thought at first it was something to do with the airbag..

it's well hidden.. inside the chassis and then behind a lot of plastic
